EIDOS PHOTOGRAPHY

These Terms apply to direct photography and videography bookings with:

The person making the booking is the "Client". A written proposal or Booking Confirmation may contain booking-specific terms. If those terms conflict with these Terms, the booking-specific terms take priority.
A booking is confirmed only when:
Unless otherwise stated, a booking payment equal to 20% of the total price reserves the time slot and is credited toward the total price. The remaining balance is due immediately after the session and before previews, downloads or final files are released.
Prices are in euros. The total price, taxes and mandatory charges will be shown before confirmation. The Client must check the date, time, package, meeting point and contact details in the Booking Confirmation.
For a standard direct booking:
A rescheduled session is subject to availability and may require payment of a price difference, permit, travel or supplier cost. A second reschedule may be treated as a cancellation.
Client-side problems such as illness, transport disruption, traffic, missed flights, invalid documents or itinerary changes normally follow the same cancellation rules. Any exception offered by Eidos is voluntary.
Severe-weather guarantee: if the session becomes impossible to start or continue, the Client may choose a reschedule or a full refund - even if the session has started.
Sessions normally continue in light rain, cloud, heat, cold or other manageable conditions. The photographer may change the route, timing, angles or nearby location to protect safety and image quality.
If, before or during the session, Eidos or the on-site photographer reasonably determines that severe rain, dangerous conditions, an official restriction, a location closure or another unavoidable event makes the booked session impossible to start or continue, the Client may choose:
The refund will normally be initiated within 14 calendar days. This full-refund promise applies even if the session had already started. It does not cover travel, accommodation or other amounts paid by the Client directly to third parties.
No weather refund is due where the session can safely continue, or Eidos can provide the service at a reasonable nearby location, but the Client simply prefers not to continue. The on-site photographer has the final decision on immediate safety.
Eidos may reasonably change the assigned photographer, route, meeting point, start time or nearby location because of illness, safety, weather, access restrictions or public events. A suitably qualified Eidos team photographer may replace the originally assigned photographer unless a named photographer was expressly made an essential booking condition.
If Eidos cannot provide the service, a suitable replacement or a reasonable rescheduled date, the Client receives a full refund of all amounts paid to Eidos for the affected booking. Eidos is not responsible for separate travel, hotel, clothing, venue or opportunity costs, except where the law does not allow that limitation.
The session starts at the confirmed time. Client lateness reduces the available shooting time and may reduce the number or variety of delivered images without reducing the price.
The photographer is not required to wait more than 15 minutes unless otherwise agreed. After that time, the booking may be treated as a non-refundable no-show.
The photographer may stop a session for harassment, threats, intoxication, unsafe behaviour, illegal access or serious disregard of safety instructions. No refund is due where the Client or a participant causes the session to end.
Outdoor sessions take place in changing public environments. Eidos cannot guarantee specific weather, light, empty landmarks, uninterrupted access, decorations, fountains, viewpoints or an exact background shown in a reference image.
Unless expressly included, the Client is responsible for permissions and admission, permit, parking, transport or activity fees required by a Client-selected location. If access is unexpectedly restricted, Eidos may use a reasonable nearby alternative.
The Client must provide accurate information about group size, mobility needs and material requirements. A responsible adult must supervise every participant under 18. The booking adult confirms they have authority to arrange the session for all participants.
By booking, the Client confirms that they have reviewed and accepted Eidos's photographic style. Selection, composition, posing, lenses, colour treatment and editing remain within Eidos's reasonable professional and creative discretion.
Only the number of edited images stated in the package or Booking Confirmation is included. Standard editing does not include major body or face alteration, object removal, background replacement or advanced compositing unless separately agreed.
Standard Rome sessions are normally delivered as high-resolution JPEG files through a private gallery within 48-72 hours. Weddings, events, video, advanced retouching and custom work may take longer. Unless expressly guaranteed in writing, delivery times are estimates.
Where Client selection is included, the Client must normally submit one complete selection within seven days. The delivery estimate starts after the complete selection is received. If no selection is received within 14 days, Eidos may choose the images, archive the project or charge a reasonable reactivation fee.
RAW files, unedited files, project files and unselected images are not included and do not have to be delivered or sold.
The Client must download and back up delivered files before the gallery expires. Unless otherwise stated:
Recovery or gallery reactivation is not guaranteed and may involve a fee.
The Client should report a missing file, corrupt download or clear technical issue within seven days of delivery so Eidos can investigate while working files may still exist. This does not remove any mandatory legal right.
Where a valid issue exists, Eidos may correct or re-export files, make a reasonable re-edit within the original scope, provide an alternative image, offer a proportionate reduction, arrange a re-shoot or refund the affected service.
A result consistent with Eidos's portfolio and the agreed editing scope is not defective merely because of subjective preference, weather, crowds or a change of mind.
Copyright remains with the photographer. After full payment, the Client receives a perpetual, worldwide, non-exclusive licence to download, store, print and share the delivered files for personal, non-commercial use, including personal social media.
Without written permission, the Client may not sell the files, use them for a business or paid promotion, remove watermarks, materially alter them, claim authorship, or use them for AI training, facial-recognition datasets, NFTs or misleading synthetic content. Commercial use requires a separate written licence.
Booking does not automatically permit Eidos to publish identifiable Client photographs for its portfolio, website, social media or advertising.
Promotional use requires a separate, optional and specific consent or model release. Refusing consent does not affect the booking. Consent may be withdrawn for future use by emailing Eidos; withdrawal does not make earlier lawful use unlawful.
Where the Italian Consumer Code gives a consumer a 14-day right to withdraw from a distance contract, that right remains unaffected.
If the Client asks Eidos to begin work during that period and later validly withdraws, Eidos may charge a proportionate amount for work already performed. After full performance, the right may be lost only where the Client gave the legally required express request and acknowledgement. The voluntary cancellation policy in Section 3 remains available where it is more favourable.
To withdraw, email hello@eidosphotography.com with the Client's name, booking reference, booking date, session date and a clear statement of withdrawal.
If a technical failure causes total loss of the agreed deliverable, Eidos will offer a re-shoot or refund of the affected service. A partial loss may receive a proportionate remedy.
To the fullest extent permitted by law, Eidos is not liable for indirect loss, lost opportunity, emotional disappointment or unrelated travel, accommodation, venue or supplier costs. Eidos's total liability for a booking will not exceed the amount paid for the affected service.
Nothing excludes liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by fault, or any mandatory consumer right or liability that cannot lawfully be limited.
For bookings made through GetYourGuide, Viator or another marketplace, that platform's payment, cancellation, refund and dispute rules take priority where applicable. Requests must normally be made through the same platform.
These Terms are governed by Italian law without removing mandatory protections available to a consumer under the law of their habitual residence. Mandatory consumer-jurisdiction rules apply. For business Clients, the courts of Rome have exclusive jurisdiction unless agreed otherwise in writing.
